Yes, they enable the site’s or service provider’s systems to recognize your browser and capture and remember certain information. At Area 13 Training Systems we use cookies to help us remember and process the items in “My Cart”. They are also used to help us understand your preferences based on previous or current site activity, which enables us to provide you with improved services. We also use cookies to help us compile aggregate data about website traffic and website interaction so that we can offer better website experiences and tools in the future. We use cookies to:

  • Understand and save user preferences for future visits and experience; 

  • Manage advertisements (organizational management);

  • Compile aggregate data to better website function and experience; and

  • You can choose to have your cookies enabled or disabled (in which your computer will warn you each time a cookie is being sent, or you can choose to turn off all cookies). You this through your preferred browser (e.g. Internet Explorer) settings. However, each browser is a different, and we at Area 13 Training Systems do not provide any technological service. Consult your browser and it’s “Help” menu to learn the correct way to manage your cookies. Let it known, if you choose to disable cookies, some features will be disabled which may affect the users experience that make your website experience more efficient and some of our services will not function properly. However, you can still contact us about purchasing a service.

 

Third Party Disclosure

  • We do not sell, trade, or otherwise transfer to outside parties your Personally Identifiable Information unless the client directs it. This does not include website hosting partners and other parties who assist us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. We may also release your information when we believe release is appropriate to comply with the law, enforce our website policies, or protect ours or others’ rights, property, or safety. However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses.

 

Third Party Links

  • Occasionally, at our discretion, we may include or offer third party products or services on our website. As a client, you may even inform us you are using a third party service (e.g. Physiotherapist). These third party websites have separate and independent privacy policies (and other policies). We therefore have no responsibility or liability for the content and activities of these linked websites. We seek to protect the integrity of our website and welcome any feedback about these websites, positive or negative.

 

Google

  • Google’s Advertising Principles can sum up Google’s advertising requirements. They are put in place to provide a positive experience for users and all parties involved (https://support.google.com/adwordspolicy/answer/1316548?hl=en).

  • We use a host that is associated with Google, thus we have Google as a third party associated with our website. Google, as a third party vendor, is not associated with Area 13 Training Systems.

  • We use Visitor Analytics to view metrics for website usage. We don’t use Adwords or sell advertising in a display network.

  • All of the above are sanctioned by our host.

 

Privacy Protection Acts

  • CalOPPA is the first state law in North America to require commercial websites and online services to post a privacy policy. The law’s reach stretches well beyond California to require a person or company the world [essentially] that operates websites collecting Personally Identifiable Information from California consumers to post a conspicuous privacy policy on its website stating exactly the information being collected and those individuals with whom it is being shared, and to comply with this policy. According to CalOPPA we agree to the following:

  • Anonymous users can visit our website.

  • This Privacy Policy is added to a link on our home page, or as a minimum on the first significant page after entering our website (Checkout and Member pages).

  • Privacy Policy link includes the word “Privacy”, and can be easily be found on the page specified above.

  • Users will be notified of any Privacy Policy changes on our Privacy Policy Page.

  • Users can email us to change their personal information or request a phone call.

 

How does our site handle do not track signals? 

  • Area 13 Training Systems does not track plant cookies or use advertising when a Do Not Track (DNT) browser mechanism is in place. We honour do not track signals.

 

Does our site allow third party behavioural tracking?

  • We do not allow third party behavioural tracking (COPPA-- Children Online Privacy Protection Act). When it comes to the collection of Personal Identifiable Information from children under 13, the Children’s Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission and The Nation’s Consumer Protection Agency enforce said COPPA Rule, which spells out what operators of websites and online services must do to protect children’s privacy and safety online (we at Area 13 Training Systems do not specifically market to children).

 

Fair Information Practices

  • The Fair Information Practices Principles form privacy law in Canada and the United States of America, and Area 13 Training Systems relies on these concepts. Understanding the Fair Information Practice Principles and how they should be implemented is critical to comply with the various privacy laws that protect Personal Identifiable Information. In order to be in in accordance with Fair Information Practices the following responsive action will occur should a data breach occur:

  • We will notify the user(s) via email within 5 business days; and

  • We will notify the user(s) via in website notification within 5 business days

  • We also agree to the Individual Redress Principle, which requires that individuals have a right to pursue legally enforceable rights against data collectors and processors who fail to adhere to the law. This principle requires not only that individuals have enforceable rights against data users, but also that individuals have recourse to courts or a government agency to investigate and/or prosecute non-compliance by data processors.

 

CAN SPAM Act

  • The CAN-SPAM Act is a law that sets the rules for commercial email. This establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and sentences penalties for violations. We collect your email address in order to:

  • Consult, handle urgent matters, and send information agreed upon (e.g. programming).

  • Purchase processing and associated updates.

  • Market for renewal.

  • To be accordance with CANSPAM we agree to the following:

  • To not use false or misleading subjects on emails (or contacts);

  • To identify the message as an advertisement in some reasonable way;

  • Include the physical address of our business or site headquarters (if applicable);

  • Monitor third party email marketing services for compliance (if one is used).

  • Process “unsubscribe” action/requests immediately; and

  • Allow users to unsubscribe by using the link at the bottom of each email

  • If at any time you would like to unsubscribe from receiving future emails, you can follow the instructions at the bottom of each email.
